Violating Our Constitution

Democrats are filing lawsuits against President Trump at a fast and furious rate. How much of this is to rev up the base? and how much is justifiable? And just who are the main plaintiffs? The Muckster went to his old friend, Barney Google, to get the answers. I found hundreds of articles proclaiming “Democrats Accuse Trump of Violating Constitution,” or something to that effect. They’re on it.

One typical article stated nearly 200 Congressional Democrats filed a lawsuit against President Donald Trump claiming that “by retaining interests in a global business empire he has violated constitutional restrictions on taking gifts and benefits from foreign leaders.”

Connecticut Democrat Senator Richard Blumenthal said the lawsuit includes 196 plaintiffs, more than any lawsuit ever filed against a president. That’s “Big Tent” stuff. Must be something to it. Reminds me of some other guys who violated the Constitution in the same way.

It’s Those Pesky Emoluments Again


Hardly anyone knows what an emolument is, and few care. It means a salary, fee, or profit from employment, or office. Right there is the truth of the matter, they are calling it something “We the People” aren’t familiar with to make it sound evil and criminal. This is the work of a group called Citizens for Responsibility and Ethics in Washington (CREW). You never heard of them? Me neither.

The Constitution’s Foreign Emoluments Clause declares that “no person holding any office of profit or trust under them, shall, without the consent of the Congress, accept of any present, emolument, office, or title, of any kind whatever, from any king, prince, or foreign state.” CREW reads this clause very broadly, arguing that it bars the president from receiving any payment from a foreign government.

The Whole CREW is on the Hunt


Another suit claims President Donald Trump and his staff use messaging applications that automatically delete the contents when read. This is from a Washington-based watchdog group’s lawsuit seeking court-ordered compliance with federal records retention laws. CREW, who are GOATs, not RHINOs, also asserts Trump has deleted postings made on his personal Twitter account, which it says is subject to the Presidential Records Act.

Justice Department lawyers state CREW’s claims clash with the framers’ understanding of the Constitution. “At the time of the nation’s founding,” reads the government’s brief, “government officials were not given generous compensations, and many federal officials were employed with the understanding that they would continue to have income from private pursuits.” For example:

George Washington (1789-1797) “left his nephew in charge of his highly successful business, required ‘weekly reports’ from his farm managers at Mount Vernon, and responded with detailed instructions. From his presidential office, he wrote business plans, including those for his gristmill, from which he exported flour and cornmeal to ‘England, Portugal, and the island of Jamaica."


Thomas Jefferson (1801-1809) “maintained his farm and nail factory at Monticello and exported his tobacco crop to Great Britain.”

James Madison (1809-1817) “had a tobacco plantation in Montpelier.”


James Monroe (1817-1825) “grew timber, tobacco, and grain” on his 3,500- acre Highland plantation. “While Madison’s and Monroe’s farm records apparently have not survived, the export of farm products such as tobacco to England and elsewhere had been common since colonial times.”

If the framers had sought to forbid the president from having any interest in any “private commercial transactions” with any “foreign, federal, or state instrumentality, surely someone would have raised concerns about whether foreign governments or government-owned corporations may have been among the customers of the farm and other products regularly exported by early presidents.” This is a Constitutional matter to be decided by the courts. Emotion and ideology are not proof of evil, or criminal, activity.

What’s the Real Problem?


The Muckster sees two issues here. First, the GOATs, sore losers that they are, are peering down every rabbit hole to find a way to discredit President Trump in hopes they can make him go away. That’s Plan A.

There isn’t a Plan B. The other issue is Donald Trump is the first business guy with a lot of holdings, and money, to be elected in the modern era. The rest of the leeches are all career politicians who steal public money. They say Trump is different because he stole his from the poor. Who knew the poor had that much to steal? Oh, I forgot they got it from the “gummint” and now the GOATs want it back.

Maybe that’s Plan B. I wrote earlier, the choices are between a huge expansion of the welfare state of dependency, or a small, gradual growth of the welfare state of dependency. Either way, “We the People” lose.

Who Will Win this Battle?


One person cannot violate the Constitution, in this short amount of time, as often as we are led to believe Trump has. Likewise, one person cannot purify this hideous immorality of perpetual accusations. It will take a majority of the more than 320 million American citizens to “Drain the American Swamp.”

Americans have lost faith in their overreaching federal government. “We the People” don’t need to be overregulated or have their taxes misspent. Americans are victims of a crumbling economy, high prices and stagnant wages. They view government as bloated and politicians as corrupt.

They do not trust the leadership at any level. They see politicians of both parties as self-centered narcissists whose only objective is re-election. The author is like you, with one principal difference and 20 reasons for optimism. His “Vision” of America is “clear.” It is a vision of the Constitution and America the way it could be, the way it should be. The author’s eyesight is twenty-twenty.

    Hi Bill,

    I’ve stopped worrying about Trump and our country. I believe Trump will self destruct one of these days but our country will survive just fine, as it always has in times of serious turmoil.

    About “Our Constitution” — You might consider writing something in the future about the 2nd Amendment. Today’s proliferation of guns in the hands of every Tom, Dick and Josephine has bother me a lot. As you know, the 2nd Amendment starts out with the words, “in order to provide for a well regulated militia . . . ” So all these cowboys and cowgirls toting small arms are part of this NRA-sanctioned militia? It’s too bad the Constitution (excuse me, Our Constitution) has been bastardized by . . . who?
